# Blumoni Terms of Service Effective Date: 10.12.2025 ## 1. Acceptance of Terms By installing or using the Blumoni mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the App. These Terms form a binding agreement between you and Blumoni. --- ## 2. Eligibility & Account - You must be at least 16 years old to use the App. - You are responsible for ensuring that your use of the App complies with all applicable laws in your country. - You must provide accurate and up-to-date information when creating and using your account. - You are responsible for maintaining the confidentiality of any authentication methods used with the App (for example, one-time codes, biometrics or device security). --- ## 3. Subscriptions & Payment - Blumoni may offer certain premium features or services that require a paid subscription ("Subscription"). - Where Subscriptions are offered, they are managed through the relevant app store (for example, Google Play). Billing, renewal, cancellation and refunds are governed by the app store’s own terms and policies. - The specific pricing, billing period and included features will be presented to you in the app store and/or within the App before you subscribe. - You are responsible for any charges and fees associated with your use of the app store and your Subscription. During internal or test phases, some or all paid features may be disabled or made available for free. This does not change the applicability of these Terms once Subscriptions are enabled for general users. --- ## 4. Use of the App You agree to use the App only for lawful purposes and in a manner that does not: - Violate any applicable law or regulation. - Infringe the rights of others. - Interfere with or disrupt the App, servers or networks. - Attempt to gain unauthorized access to any systems or data. You must not: - Reverse engineer, decompile, disassemble or attempt to derive the source code of the App, except where permitted by law. - Circumvent, disable or otherwise interfere with security-related features of the App. --- ## 5. Financial Information & Open Banking Blumoni is a **personal finance and expense-sharing tool**. It is not a bank, financial institution or investment advisor. - Any bank data you choose to import (such as transactions and balances) is obtained via regulated open banking providers (for example, Salt Edge, GoCardless, or similar providers), according to their terms and your bank’s security requirements. - Calculations, analytics, summaries and insights provided by the App are for information purposes only. They may not always be complete or free from errors. - You remain solely responsible for your financial decisions and obligations, including payments, transfers and tax reporting. Blumoni does not execute bank transfers or hold customer funds. --- ## 6. Data Protection & Privacy Your use of the App is also governed by our Privacy Policy, which describes how we collect, use and protect your personal data. You can view the current Privacy Policy at: - **In the App:** via Settings → Legal / Privacy - **On the web:** for example at `https://blumoni.com/privacy` (or another URL we communicate to you) By using the App, you acknowledge that you have read and understood the Privacy Policy and agree to our processing of your data as described there. --- ## 7. Intellectual Property The App, including its design, code, text, graphics, logos and other content, is owned by or licensed to Blumoni and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial use in accordance with these Terms. Nothing in these Terms transfers any ownership rights in the App to you. --- ## 8. Disclaimers - The App is provided **"as is"** and **"as available"** without warranties of any kind, whether express or implied. - We do not guarantee that the App will be uninterrupted, error-free, secure, or that data will always be accurate or up to date. - To the maximum extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. You are responsible for verifying the accuracy of any financial information before relying on it. --- ## 9. Limitation of Liability To the maximum extent permitted by law: - Blumoni and its owners, employees, and partners are **not liable** for any indirect, incidental, consequential, special or punitive damages, or for any loss of profits or data, arising out of or in connection with your use of the App. - Our total aggregate liability arising under or in connection with these Terms or your use of the App will not exceed the amount you have paid for the App or Subscriptions in the preceding 12 months (if any), or a reasonable equivalent where no payments have been made. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law. --- ## 10. Termination We may suspend or terminate your access to the App at any time, with or without notice, if: - You materially breach these Terms; - We are required to do so by law or by an app store provider; or - We decide to discontinue the App. You may stop using the App at any time and may request deletion of your data as described in the Privacy Policy. Upon termination, the rights granted to you under these Terms will immediately cease, but sections that by their nature should survive (for example, limitations of liability and dispute provisions) will remain in effect. --- ## 11. Governing Law Unless otherwise required by mandatory local law, these Terms are governed by and construed in accordance with the laws of Croatia, without regard to its conflict of laws principles. If you are a consumer in the EU/EEA, you may also be entitled to rely on certain mandatory consumer protection provisions of your country of residence. --- ## 12. Changes to These Terms We may update these Terms from time to time, for example to reflect changes in the App or in applicable law. When we do so, we will update the effective date at the top of this document and may notify you via the App or other appropriate means. Your continued use of the App after the updated Terms become effective constitutes your acceptance of them. --- ## 13.
